TERMS AND CONDITIONS

PRICES: This price list cancels and supersedes previous price lists or offerings. All prices are quoted on a per plant basis in United States Dollars, F.O.B. Altha, Florida, USA and includes royalties where applicable. Pricing, specifications, availability and terms of offer are subject to change without notice. Any taxes, fees, documentation, boxing and shipping charges are extra.

TERMS: Payment prior to shipment unless Net 30 day credit has been established and payment terms upheld. All payments must be in United States Dollars via wire transfer, cash, credit card (Visa or Mastercard), or check drawn on a United States bank. We reserve the right to cancel pre-booked orders on past due accounts.

MINIMUM: Per variety minimum order quantities vary pending product type and package quantities: 900 to 1,200 for stage II or stage III and four (4) trays except where noted for stage IV young plants. Less than minimum quantity orders are subject to a 15% surcharge.

PACKING: $8.00 per box/$9.00 per box for additional packaging highly recommended for express service.

SHIPPING: Air freight, air parcel post, UPS, FedEx, or customer's choice. All at customer's risk. Florida customers purchasing stage IV young plants may qualify for door to door delivery eliminating boxing charges. Fuel surcharges may apply.

INTERNATIONAL SHIPMENTS: International orders are confirmed with proforma invoices with specific ship and payment due dates. Phytosanitary certificates and other documentation required for international shipments of live plants are $55.00 per shipment. We may require Import Permits depending on the destination country. Additional fees may apply for CITES permits and/or compliance with special regulatory requirements of the destination country or state. Due to the possibility of air-borne contamination occurring during transit, we accept no responsibility for quarantine rejection of Stage III plants at the destination country. International shipments are subject to a 10% surcharge.

PRODUCT LIABILITY: To the extent of the purchase price we warrant that the plants are as invoiced. No other warranty either expressed or implied including warranties of saleability or fitness for a particular purpose is extended. All orders are accepted on the terms and conditions stated on our standard invoices and/or order confirmations. Copies are available by written request.

CANCELLATION CLAUSE: Twelve (12) weeks. Orders prepared for shipment and canceled or not picked up will be charged 3% restocking charge.

DISCOUNTS: Substantial discounts available for volume purchases and prompt payments. Please inquire.

Any asexual reproduction of a patented plant or use of trademarks without written consent from owner is illegal and subject to prosecution under United States Patent and Trademark laws.
